Terms of Service
By placing an order with Utah Moving Box Rental ("Company," "we," "us," or "our"), you ("Customer," "you," or "your") agree to be bound by these Terms of Service. Please read these terms carefully before using our services.
1. Acceptance of Terms
By accessing our website, placing an order, or using our rental equipment, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and any applicable laws and regulations. If you do not agree with any part of these terms, you may not use our services.
These terms apply to all users, visitors, and others who access or use our services.
2. Service Description
Utah Moving Box Rental provides rental services for plastic moving boxes and related moving equipment. All equipment remains the property of Utah Moving Box Rental throughout the rental period.
3. Rental Period and Charges
3.1 Rental Duration
- Packages rent by the week (7 consecutive days)
- All equipment included in a package is rented for the same duration
- Rental period begins on the delivery date and time
- Example: A 1-bedroom package rented for 3 weeks equals 21 days. Beginning on day 22, late fees apply at $1.15 per piece of equipment per week unless other arrangements have been agreed to in writing
3.2 Late Fees
- Residential rate: $1.15 per piece of equipment per week
- Commercial rate: [Insert commercial rate]
- Late fees are calculated weekly and charged automatically to the payment method on file
- Partial weeks are charged as full weeks
3.3 Automatic Purchase Assumption
If equipment is not returned within 30 days of the rental end date and no written extension has been arranged, Customer will be automatically charged the full retail value of all unreturned items. This constitutes an involuntary purchase of the equipment.
4. Payment Terms
4.1 Payment Methods
- All payments must be made by credit or debit card
- Payment is due in full at the time of booking
- We reserve the right to place authorization holds on your payment method
4.2 Additional Charges
- Late fees, damage fees, replacement costs, and additional trip charges will be automatically charged to the payment method on file
- Customer is responsible for ensuring payment method remains valid throughout rental period
5. Delivery and Pickup
5.1 Service Area
- Standard service area is defined as [insert specific geographic boundaries]
- Deliveries outside the standard service area may incur additional charges
- Customer will be notified and must approve any additional charges before scheduling
5.2 Delivery and Pickup Procedures
- One delivery and one pickup per service address is included
- Customer must be present during scheduled delivery/pickup times
- An adult (18+ years) must be available to sign for delivery and confirm pickup
- Multiple orders to the same address do not qualify for additional trips unless agreed to in writing
5.3 Scheduling
- Delivery and pickup times are scheduled by mutual agreement
- Customer will receive confirmation 24 hours prior to scheduled delivery/pickup
- A 15-minute grace period applies to all scheduled appointments
5.4 Failed Delivery/Pickup Attempts
- Failed attempts result in a $25 charge per occurrence
- A failed attempt occurs when:
- No one is present at the scheduled time (±15 minutes)
- Access to the property is denied or unavailable
- Customer cancels within 2 hours of scheduled appointment
- Weather-related cancellations initiated by Utah Moving Box Rental will not incur charges
6. Equipment Care and Responsibility
6.1 Customer Responsibility
- Customer has sole responsibility for equipment care during rental period
- Equipment must be returned in the same condition as delivered, normal wear excepted
- Customer must immediately notify us of any damage or loss
- Equipment may only be used for its intended purpose (moving/storage)
6.2 Prohibited Uses
Equipment may not be used for:
- Storage of hazardous materials, liquids, or perishables
- Commercial purposes beyond agreed rental terms
- Any illegal activities
- Outdoor storage without proper protection from elements
6.3 Inspection
- Customer should inspect all equipment upon delivery and report any pre-existing damage immediately
- Failure to report damage within 24 hours of delivery may result in Customer being held responsible
7. Damaged or Lost Equipment
7.1 Replacement Costs
- Rental Box (Standard/Large): $25 each
- Upright Hand Cart: $120 each
7.2 Damage Assessment
- Normal wear and tear is expected and will not incur charges
- Damage requiring replacement will result in full replacement cost charges
- Utah Moving Box Rental reserves the right to determine what constitutes excessive damage
8. Limitation of Liability
8.1 Property Damage
- Utah Moving Box Rental is not responsible for damage to Customer's personal property
- Customer assumes all risk associated with equipment use
- We recommend Customer verify their insurance coverage for rental equipment
8.2 Maximum Liability
- Our total liability shall not exceed the total amount paid by Customer for rental services
- We are not liable for indirect, incidental, or consequential damages
9. Indemnification
Customer agrees to indemnify and hold harmless Utah Moving Box Rental from any claims, damages, or expenses arising from Customer's use of the equipment or breach of these terms.
10. Privacy Policy
10.1 Information Collection
- We collect information necessary to provide rental services
- Personal information is not sold or shared with third parties
- Exception: Information may be shared for collection purposes in case of non-payment
10.2 Data Security
- We implement reasonable security measures to protect Customer information
- Customer is responsible for maintaining confidentiality of account information
11. Cancellation Policy
11.1 Customer Cancellations
- Cancellations made 24+ hours before delivery: Full refund
- Cancellations made less than 24 hours before delivery: 50% cancellation fee
- Cancellations made less than 2 hours before delivery: Full charge applies
11.2 Company Cancellations
- We reserve the right to cancel orders due to equipment unavailability, weather, or other circumstances beyond our control
- Full refund will be provided for Company-initiated cancellations
12. Force Majeure
Utah Moving Box Rental is not liable for delays or failures in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, weather, government actions, or other force majeure events.
13. Governing Law and Disputes
13.1 Governing Law
These Terms are governed by the laws of the State of Utah.
- Cancellations made 24+ hours before delivery: Full refund
- Cancellations made less than 24 hours before delivery: 50% cancellation fee
- Cancellations made less than 2 hours before delivery: Full charge applies
13.2 Dispute Resolution
- Disputes shall be resolved through binding arbitration in Utah
- Customer waives right to jury trial and class action participation
- Small claims court disputes under $5,000 may be exempt from arbitration requirement
14. Modifications
Utah Moving Box Rental reserves the right to modify these Terms at any time. Changes will be posted on our website and effective immediately. Continued use of services constitutes acceptance of modified terms.
15. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.
